In a move to support foreign workers in British Columbia (BC), the Canadian government has introduced a new policy expanding work permit eligibility for spouses and common-law partners. This policy, which took effect on March 23, 2026, applies to workers employed at two prominent companies: Lululemon Athletica and Microsoft Vancouver. Spouses of foreign workers at these companies are now eligible for open work permits, allowing them to work in most industries across Canada.

Key Changes for Spouses of Foreign Workers

Before this policy change, only the spouses of highly skilled foreign workers in certain occupations were eligible for open work permits. Now, under the new rules, spouses of workers in both high-skilled and low-skilled jobs are eligible. This includes positions classified under the National Occupational Classification (NOC) as TEER levels 0, 1, 2, 3, and even 4 or 5.

The government’s decision to expand eligibility reflects a broader effort to attract and retain skilled workers while providing more flexibility for their families. It will also benefit workers who have provisional job offers at these two companies. If a foreign worker has a letter of introduction confirming their role at Lululemon or Microsoft, their spouse can apply for a work permit before the worker begins their employment.

Eligibility Requirements

To qualify for the open work permit, the foreign worker must meet a few criteria. They must be authorized to work in Canada, either through a valid work permit or provisional approval. Additionally, the worker must be employed or slated to be employed in a high-skilled or low-skilled job at Lululemon or Microsoft. The foreign worker must also reside in Canada or plan to, while being in a genuine spousal or common-law relationship.

The new policy is less restrictive than previous ones. Normally, foreign workers had to have at least 16 months of work authorization for their spouse or partner to apply for a work permit. This rule no longer applies to those employed at the two eligible companies. This change has simplified the process for many families and allows them to start working sooner.

How to Apply for the Work Permit

Immigration, Refugees and Citizenship Canada (IRCC) has provided clear instructions on how to apply for the new open work permit. Eligible spouses need to submit a standard work permit application and enter a special code, “SIPSPOUSEBC,” in the “Job Title” field of the application form. This helps distinguish applications under the new policy.

Applicants must also prove their relationship is genuine. They can submit a marriage certificate or a Statutory Declaration of Common-Law Union, along with evidence that the foreign worker has been authorized to work in Canada under a Significant Investment Project agreement.

Changes in Canada’s Broader Immigration Policy

This change comes amid broader shifts in Canada’s immigration policies. In 2024, the government made it more difficult for spouses of foreign workers and international students to obtain open work permits. Beginning January 2025, spouses will only be eligible for work permits if their partner is employed in high-skilled jobs or is studying at select levels of education, such as a master's program or doctorate. These measures are part of Canada’s broader plan to manage the population of temporary residents.

Despite these restrictions, the new provisions for spouses of foreign workers in BC are a step forward in making it easier for families to stay together while pursuing work opportunities.
