Work Permits In Canada Made Easier For Citizens Of These Nations

People from countries that have trade deals with Canada can apply for special work permits without needing a Labour Market Impact Assessment (LMIA).

People from certain countries have an advantage when applying for Canadian work permits. If your country has a Free Trade Agreement (FTA) with Canada, you might get a special work permit that does not need a Labour Market Impact Assessment (LMIA). This makes the process faster, cheaper, and less complicated.

What Is an LMIA-Exempt Work Permit?
Usually, employers must get an LMIA to hire foreign workers, proving no Canadian can fill the job. But for countries with FTAs, this step is often skipped. This helps foreign workers get permits more easily.

Which Countries Qualify?
Countries with FTAs include the United States, Mexico, European Union members, Australia, Japan, Malaysia, and many others. Each country’s agreement offers different types of permits and rules.

Types of Work Permits Under FTAs
Here are some major agreements and what they allow:

  • CUSMA (Canada-US-Mexico Agreement): For US and Mexican citizens. Eligible workers include professionals with job offers, company managers transferring to Canada, investors, and traders. Permits can last from one to five years, depending on the role.
  • CETA (Canada-EU Agreement): For citizens of EU countries. Categories include professionals, company transferees, investors, and technologists. Work permits last up to two years and vary in job eligibility and contract types.
  • CPTPP (Trans-Pacific Partnership): Covers countries in the Indo-Pacific like Australia, Japan, and Vietnam. It offers permits to professionals, managers, investors, and technicians, usually for one year or longer.
  • CCFTA (Canada-Chile Free Trade Agreement): Citizens of Chile can get permits as professionals, company transferees, or investors. Permit lengths range from one to five years.
  • CCoFTA (Canada-Colombia Free Trade Agreement): Similar categories as other FTAs, including professionals, managers, technicians, and traders, with permits lasting one to three years.

What Are the Basic Requirements?
You need a job offer from a qualified employer under the FTA rules. You must meet education and experience standards for your job, hold necessary certifications or licenses, and be allowed to enter Canada.

How to Apply for an FTA Work Permit

For Employers:

  1. Submit the job offer online.
  2. Pay a compliance fee.
  3. Give the worker an offer of employment number.

For Workers:

  1. Check your eligibility for the specific FTA and job category.
  2. Read government instructions carefully.
  3. Collect all required documents, like diplomas and work certificates.
  4. Pay the work permit fee.
  5. Apply online to Immigration, Refugees and Citizenship Canada (IRCC).
  6. Provide biometrics if asked and pay the fee.

Keep in mind, meeting all rules doesn’t guarantee approval. Immigration officers review each case carefully. Processing times vary by country but usually take between three weeks and five months.

What Does This Mean for Workers?
If you come from an FTA country, your chances to work in Canada improve. These permits offer faster, smoother access without the usual LMIA hurdles. It helps businesses find skilled workers quickly and helps workers start jobs in Canada sooner.
