Millions of Americans May Qualify for Canadian Passports Under New Law

A new Canadian citizenship law now allows millions of Americans with Canadian ancestry to claim Canadian citizenship and apply for Canadian passports.

The change expands the rules for citizenship by descent. People who can trace their family history to a Canadian ancestor now qualify for citizenship even if they were born outside Canada.

Who Can Qualify Under the New Law

Anyone born before December 15, 2025, who can prove Canadian ancestry may qualify for citizenship under the updated rules. Birthplace does not matter. A person’s parents or grandparents also do not need to have lived in Canada or held Canadian passports.

The law simply requires proof that a Canadian ancestor exists in the family line. Once applicants provide documents confirming their lineage, they can apply for proof of Canadian citizenship.

After authorities confirm citizenship, applicants may request a Canadian passport.

The rules apply to both children born into a family and those adopted by Canadian citizens.

Large Number of Americans Could Qualify

The new law could affect millions of Americans across the United States. Many families in the country have Canadian roots.

The impact may be especially large in New England, where historians estimate that around three million people may qualify for Canadian citizenship because of family connections.

Large numbers of Canadians moved to the region between 1870 and 1930, creating family ties that continue across generations.

Benefits of Dual Citizenship

Americans who receive Canadian citizenship can keep their United States citizenship while also gaining the rights of a Canadian citizen.

Dual citizens can enter Canada freely and live in the country permanently if they choose to move there. They can also apply for Canadian passports, which provide travel access to many countries around the world.

For some people, holding passports from both countries offers greater flexibility for work, travel, and family life.

How People Can Apply

Applicants must submit documents showing their connection to a Canadian ancestor. These records often include birth certificates, baptism records, or other family documents that show the family line.

Officials currently take about 11 months to process applications for proof of Canadian citizenship.

Once authorities approve the request, applicants can move forward with a Canadian passport application.

No Tax Obligation for Dual Citizens Abroad

Canadian citizenship does not automatically create a tax burden for Americans who remain outside Canada.

Canada collects income taxes based on residency, not citizenship. Americans who gain Canadian citizenship but continue to live in the United States do not need to file Canadian tax returns unless they move to Canada or earn income there.

If a dual citizen eventually settles in Canada, a tax agreement between Canada and the United States helps prevent people from paying taxes twice on the same income.

Changes to Citizenship Rules

The new law forms part of Bill C-3, which amended Canada’s Citizenship Act and took effect on December 15, 2025.

Earlier rules limited citizenship by descent to only one generation born outside Canada. Courts later ruled that restriction unconstitutional.

The updated law removed that limit for people born before the new legislation took effect. For children born afterward, the law allows exceptions when a Canadian parent has a strong connection to Canada, including living in the country for at least three years before the child’s birth or adoption.
