Canada Unveils New Advertising Rules For Employers Seeking LMIA Approval

Employers must now turn on Direct Apply when posting LMIA jobs on Canada’s Job Bank.

Employers hiring through Labour Market Impact Assessments (LMIA) now face new advertising rules. From today, they must activate the “Direct Apply” feature on Canada’s National Job Bank. They must also review every application submitted through this tool. Ignoring applicants or turning off the feature will lead to an LMIA rejection.

Impact on Employers
This rule raises the bar for compliance. Employers already needed to post LMIA jobs on the Job Bank for four weeks. They also had to use two other recruitment methods. Until now, they could choose whether to activate Direct Apply. That choice no longer exists. Every LMIA posting must allow Direct Apply by default.

Employers must accept and assess all resumes from Direct Apply. Failure to do so breaks the rules. That can mean restrictions on job postings and an LMIA refusal.

The Job Bank can also apply Direct Apply to existing job postings. If employers ignore Canadian citizens or permanent residents who apply this way, penalties follow. Restrictions can also prevent employers from meeting the four-week posting period. This makes it impossible to secure a positive LMIA.

Employers must still offer at least two other ways for candidates to apply. These can include a company website, LinkedIn, or another hiring portal.

Why Job Bank Matters
The Job Bank is Canada’s official government-run job board. Employers must post LMIA jobs there to prove they tried to hire Canadians first. Advertising is a central part of LMIA approval. Most LMIA-based jobs require advertising. Without it, employers cannot show the need for foreign workers.

Some jobs remain exempt from advertising rules. These include visiting professors, post-doctoral fellows, camp counselors, in-home caregivers, and some entertainment roles.

Temporary Foreign Worker Program Context
The Temporary Foreign Worker Program (TFWP) manages LMIA work permits. Canada has long relied on the program to address shortages in agriculture, manufacturing, and caregiving. But critics say employers sometimes misuse it. They argue that businesses use it to hire cheaper labour instead of making real efforts to recruit Canadians.

Concerns about wages, job conditions, and rising numbers of temporary residents have grown. Housing shortages and affordability issues add to the pressure. Ottawa introduced the Direct Apply rule as part of its response. The government wants to reduce the number of temporary residents and protect Canadian workers.

Impact on Job Seekers
The Direct Apply option makes it easier for job seekers. Anyone with a Job Bank Plus account can apply directly. Applicants select a resume and send it through the system. They no longer need to visit outside websites or create new accounts. This saves time and helps more Canadians and permanent residents access opportunities.
